Terms and Conditions


1. The Promoter of the ‘#athomewithilly’ consumer promotion (the “Promotion”) is illy Australia, the coffee division of F. Mayer (Imports) Pty Ltd (ABN 51 000 697 889), Unit B1/2-8 McPherson Street, Banksmeadow NSW 2019, (the “Promoter”).

2. Entry into the Promotion constitutes acceptance of these terms and conditions and the Privacy Policy. All entry instructions and prize information published by the Promoter also form part of these terms and conditions.

Competition Dates

3. The Promotion commences at 12:01 am AEST on 7 August 2021 and closes at 11:59 pm AEST on 21 August 2021 (the “Promotion Period”). All Entries must be received by the Promoter by no later than 11:59 pm AEST on 21 August 2021.

Qualifying Criteria

4. Before you can enter in the Promotion, you must meet the following criteria:

  • You must be aged eighteen (18) years or older as of the Promotion start date; and
  • You must have an Instagram account and have your profile set to ‘Public’..
  • Employees (and their immediate families) of the Promoter and its contractors and agencies associated with the Promotion are ineligible to enter. “Immediate family” means spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or 1st cousin, whether or not they live in the same household as the director, manger, employee, officer or contractor.
  • You at the time of entry must have a valid Australian residential address.

Entering the Promotion

5. Entry into the Promotion must be undertaken during the Promotion Period and as follows:

  • a. Entrants must log on to Instagram.com within the Promotion Period
  • b. Entrants must create a photo or video Instagram post of themselves enjoying coffee at home
  • c. Entrants must share this photo or video on their profile with #athomewithilly
  • d. Entrants must tag one (1) of the ten (10) influencers listed below:

Entries without #athomewithilly and without one of the influencers listed above tagged will be disqualified.

For the avoidance of doubt, there is a total of ten (10) prizes available, across the entire campaign period.

6. Entries must be original to Entrant and not contain any material created by any third party. Entries must not depict the brand name or trademark of any other company or product, or contain any lewd, vulgar, indecent, defamatory, discriminatory, obscene, offensive, or illegal conduct or material. Entries must not invade or infringe the rights of any other individual or entity, including without limitation, privacy, publicity, and intellectual property rights.

7. All entrants must have their Instagram profile switched to ‘Public’ to be included in the draw and to be contactable by the Promoter, if they are the winner. Entries from accounts that are not designated "public" or that are not otherwise visible or searchable by Sponsor using standard social media tracking and monitoring tools will be disqualified. Entrant agrees that Promotion entries may be made available by Sponsor for viewing, rating, reviewing, and commenting by the public. By entering this Promotion, Entrant waives all privacy expectations that Entrant may have otherwise had with respect to any entry.

8. The winners will be selected by a panel of two (2) independent judges who are marketing professionals, based on the following judging criteria applied to each Entrant's entry: Relevance to the Promotion Post (50%); Uniqueness (25%); and Consistency with the Promoter’s brand ideals (25%) (together, the "Criteria"). The judge’s decision is final, no further correspondence will be entered into.


9. There will be ten (10) prizes available to be won during the Promotion Period. Total maximum value of prizes is $8,334.50. Prizes are subject to availability at the time of entry and are as follows:

On 21 August 2021, the winner will be notified by Instagram Direct message. If a potential winner of any prize cannot be contacted using the information provided, or fails to respond to Sponsor's attempt to notify them of selection within twenty-four (24) hours of notification; if any prize or notification is returned as undeliverable or yields an error or undeliverable type "bounce back" message (regardless if the message is ultimately delivered to the recipient); if the potential winner fails to sign and return the Release or any other required documentation or fails to comply with these Official Rules; if a potential winner is unable or unwilling to accept the prize (or any portion) as stated; or if the potential winner cannot be verified as eligible for any reason at any time before, during, or after the Promotion Period, the potential winner is disqualified and forfeits the prize (or relevant portion, subject to Sponsor's discretion), and an alternate potential winner will be selected from among the remaining eligible entries based on the Criteria.

11. In the event that an entrant or a potential winner is disqualified or fails to claim a prize for any reason, the foregoing process will be repeated until the prize is awarded.

12. The Promoter will courier the prize to the chosen recipient’s address, as shared by the selected prize recipient on or after the 21 of August 2021.

13. If any of prizes become unavailable for reasons beyond the Promoter’s reasonable control, then another available prize of the same or lesser value will be awarded to the winning Entrant by the Promoter.

14. The stated value of the prize is correct at the commencement date of the Promotion. The Promoter accepts no responsibility for any variation in value of the prizes or the individual components of the prizes. The prizes (whether in whole or in part) are non-transferable, non-refundable and non-redeemable for cash or other goods or services. By accepting a prize a winner agrees to the applicable prize supplier Terms & Conditions.

15. If at the completion of the promotional period any unclaimed prizes will be retained by the promoter for use at their sole discretion.

Promotional and Other Obligations

16. By entering the Competition, you agree that in the event that you are deemed as a successful entrant/winner of one of the prizes referred to in these Promotion Terms and Conditions, you make yourself available for reasonable publicity purposes related to the Promotion and that (without limiting its rights), the Promoter may conduct interviews and or request photographs relating to the Promotion that are to be used for such publicity purposes and publication by the Promoter as it deems necessary.


17. The Promoter will not be liable for any loss or damage whatsoever which is suffered by you (including, without limitation, indirect or consequential loss), or for personal injury suffered or sustained, as a result of you taking part in, winning or using any of the prizes, except for any liability which cannot be excluded by law.

18. All entries become the property of the Promoter. By taking part in the Promotion, you, irrevocably assign all rights, title, and interest in your entry to the Promoter and waive any moral rights in relation to the same. You must procure all individual assignments and moral rights waivers as necessary to ensure the assignment of all rights to the Promoter in accordance with this clause.

19. The Promoter will use the information contained in your entry form in accordance with the Privacy Policy on the on the Promoter’s website at www.illy.com.au/privacy-policy.

20. If for any reason the Promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, prohibition by the relevant authorities or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion as it sees fit, subject to approval by regulatory authorities. Any entry which is made as a result of tampering with the entry process will be invalid and not eligible to win a prize.

21. These Promotion terms and conditions are to be construed in accordance with the law in New South Wales and the parties submit to the exclusive jurisdiction of the courts of New South Wales.
